Nabila Terms of Use

Please read carefully the following provisions of this Terms of Use ("Terms of Use"). This is a legal agreement between you ("you", "your" or "user") and Nabila regarding the use of Nabila software programs, including mobile applications and related documentation being installed or used by you on any of your devices (the "Software"); and/or any of the services enabled by the Software (the "Services").
By downloading or otherwise accessing the Software and/or Services, however accessed, you acknowledge that you have read, understood, and agree to be bound by the Terms of Use (including any additional guidelines and future modifications).
If at any time you do not agree to any of the Terms of Use, you may not use the Software or Services and must immediately terminate your use of the Software and all Services.
1. Account registration
1.1 Registration Requirements
To access certain features of the Services, you must register an account with Nabila. During registration, you will be required to provide basic information such as a nickname, username, and gender. This information is necessary to create and verify your account. By completing registration and accepting the Privacy Policy and User Agreement, you gain access to features including messaging, gifting, and commenting. Failure to provide required information will restrict your use of registered-only functionalities.
Optional information—such as profile avatar, birthday, personal signature —may enhance your experience but is not essential for basic service access.
1.2 Account Security
You are solely responsible for maintaining the confidentiality of your account credentials. Do not disclose your login details to others. Promptly notify us via the "Customer Service" channel if you suspect unauthorized access or unusual account activity. You bear full responsibility for all actions conducted through your account, whether authorized by you or not.
1.3 Information Accuracy and Updates
You agree to provide accurate, truthful, and verifiable information during registration and thereafter. You must promptly update details as needed to comply with anti-fraud or other regulatory requirements.
2. User Representations and Use Restrictions
2.1 Permitted Use and Restrictions
You are granted a limited, non-transferable license to use the application solely for personal and non-commercial purposes in accordance with these Terms. This license covers only the object code version of the Software. You expressly agree not to:
a. Copy, modify, adapt, translate, or create derivative works based on the Software or Services;
b. Integrate any portion of the Software into other programs or combine it with external code;
c. Sublicense, lease, sell, assign, or commercially exploit the Software or Services;
d. Reverse engineer, decompile, or attempt to derive source code or underlying algorithms;
e. Remove, obscure, or alter copyright or proprietary notices;
f. Use the Software to develop viruses or circumvent digital rights management systems.
2.2 Prohibited Conduct
You further represent and warrant that you will not:
a. Use the Software or Services for illegal or unauthorized purposes;
b. Disrupt, overload, or impair the functionality of the Services;
c. Employ automated systems (e.g., bots, spiders) to generate excessive server requests;
d. Transmit malicious code, viruses, or harmful data;
e. Distribute spam, chain letters, political content, or unsolicited commercial messages;
f. Share, display, or transmit Content that is unlawful, threatening, pornographic, abusive, defamatory, invasive of privacy, harassing, violent, hateful, or otherwise objectionable. Content that promotes criminal activity or civil liability is strictly prohibited.
3. Storage and deletion of your Content
Storage space is inherently limited and as a result we are careful not to overload our servers. Accordingly, you acknowledge and agree that Nabila is not under any obligation to preserve, provide access to or return to you any Content and that Nabila shall have no responsibility for the modification, loss, deletion or destruction of any Content, including any stored Content. You further understand and agree that Nabila may remove certain Content from its storage systems periodically in its discretion without notice to you.
4. Termination
You may terminate your use of the Services at any time by uninstalling the Software from all your devices. If you have subscribed to any Premium Services, you are solely responsible for canceling future payment obligations through the relevant app store or payment service. You may also request account deletion prior to uninstalling the Software. Upon account deletion, Nabila will remove your content and account details, except where retention is necessary to comply with legal obligations.
Nabila may, at its sole discretion and without prior notice or judicial intervention, take actions including removing content, restricting access, suspending, or terminating your use of the Software or Services for any reason, including but not limited to:
a. Violation of these Terms of Use;
b. Creation of legal or regulatory risks;
c. Non-payment for Premium Services;
d. Infringement of third-party intellectual property rights;
e. Sharing of objectionable content;
f. Engagement in fraudulent, illegal, or harmful activities; or
g. Actions threatening the safety of the Nabila user community.
You acknowledge that Nabila is not obligated to provide the Services, and neither Nabila nor its partners shall be liable for any limitation, suspension, or termination of your access.
5. Availability and New Versions of the Software
Nabila reserves the right to modify, limit, suspend, or discontinue any aspect of the Software or Services—including specific features or overall availability—at any time, with or without prior notice. This may include imposing usage limits or terminating access for individual users or all users generally.
Nabila may, at its sole discretion, introduce additional features, functions, or programming updates to the Software or Services. There is no obligation to provide such enhancements, including ongoing support, maintenance, or new versions.
By continuing to use the Software or Services, you acknowledge and agree that Nabila may automatically deliver modifications, updates, or upgrades to the Software installed on your device. Your device may periodically request or receive such updates. If additional features or new versions require updated terms, you must accept the revised Terms of Use prior to access or use.
6. Intellectual Property Rights
All text, data, images, graphics, audio and/or video information and other materials within the Services provided by Nabila are property of Nabila are protected by copyright, trademark and/or other property rights laws. Nothing in this Agreement shall be construed as conferring any license of any intellectual property rights or such materials by Nabila to you.
By using and/or uploading any content or other content through a Nabila Services to publicly accessible areas of Nabila app, you grant to Nabila and its sub-licensees the permission, free, permanent, irrevocable, non-exclusive and fully sub-licensable rights and license, without any territorial or time limitations and without requiring any approvals and/or compensations, to use, copy, modify, adapt, publish, translate, edit, dispose, create derivate works of, distribute, perform and publicly display such content (in whole or in part), and/or incorporate such content into existing or future forms of work, media or technology.
7. Terminating Services
To the fullest extent permitted by applicable law, Nabila reserves the right, at its sole discretion and without prior notice, to suspend or terminate your license to access and use the Services—including the ability to post User Content—and to block future access. Such action may be taken if we reasonably determine that:
a. You have violated this Agreement or applicable law;
b. You have engaged in fraudulent or improper use of the Services; or
c. Technical or legitimate business reasons prevent the continued provision of Services to you.
This includes the suspension or termination of access to any services. Your sole remedy for dissatisfaction relating to the Services, these Terms, Nabila’s policies, or any content transmitted through the Services shall be to discontinue use of the Services and terminate your account.
